Amendment to the Courts Law Has Entered into Force

Amendments made to certain articles of the Courts Law No. 9/1976 have entered into force following their publication in the Official Gazette.

The statutory interest rates regulated under Article 42 of the Courts Law had not been amended since the Constitutional Court’s decision issued on the matter.

With the amendment, statutory interest rates have been aligned with a system determined according to current financial market rates and have been revised to reflect the deposit interest rate practices of the TRNC Central Bank.

Regarding torts, the previous provision applying half of the statutory interest rate has been amended, and the statutory interest rate has been fixed.

The legal amendment also provides a legal basis for the electronic registry and archive system and establishes the necessary legal framework for maintaining case files electronically.

As is known, as of January 1, 2025, all newly filed cases have been created as electronic files through the lawyer portal. Another aspect of the amendment is the update of the courts’ jurisdiction in civil and criminal cases by increasing the applicable monetary limits.
